Terms of Service

1. Acceptance

By accessing or using theobsidian.com, our apps, newsletters, or any related service (the "Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. The Service

The Obsidian Media Co. provides independent journalism through a website, mobile applications, email newsletters, and paid subscriptions. We may add, change, suspend, or discontinue features at any time with reasonable notice.

3. Accounts

You are responsible for safeguarding your credentials and for all activity under your account. You must provide accurate registration details and notify us promptly of any unauthorised use at contact@theobsidian.com.

4. Subscriptions and billing

Paid subscriptions renew automatically at the rate then in effect until cancelled. You may cancel at any time from your account; cancellation takes effect at the end of the current billing period. We do not generally provide refunds for partial periods, but we may do so at our discretion.

5. Pricing

Prices are displayed inclusive of applicable taxes where required. We may change prices on renewal with at least 30 days' notice by email.

6. Intellectual property

All content published by The Obsidian — text, photography, illustrations, audio, code, and design — is owned by us or our licensors and protected by copyright and other laws. You may read, save, and share links to articles for personal, non-commercial use. Republication, scraping, or use to train machine-learning models without a written licence is prohibited.

7. Acceptable use

You agree not to (a) circumvent access controls or paywalls, (b) use automated tools to harvest content, (c) impersonate any person, (d) post or transmit unlawful, defamatory, or infringing material, or (e) interfere with the Service or other users.

8. User submissions

When you submit tips, comments, letters, or other material, you grant us a non-exclusive, worldwide, royalty-free licence to publish, edit, and otherwise use the submission in connection with the Service. You confirm that the submission is yours to share.

9. Third-party services

The Service may link to or rely on third-party sites and services. We are not responsible for their content or practices. Your use of those services is subject to their own terms.

10. Disclaimer

The Service is provided "as is". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement. Journalism is not legal, financial, medical, or other professional advice.

11. Limitation of liability

To the maximum extent permitted by law, The Obsidian and its officers, employees, and contributors will not be liable for indirect, incidental, special, or consequential damages. Our total liability for any claim arising out of the Service will not exceed the amount you paid us in the 12 months preceding the claim.

12. Termination

We may suspend or terminate access if you breach these Terms. You may stop using the Service at any time. Sections that by their nature should survive termination will do so.

13. Governing law

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules. Disputes shall be brought exclusively in the courts located in New York County, New York.

14. Changes

We may revise these Terms from time to time. Material changes will be communicated by email or via a notice on the site. Continued use after changes take effect constitutes acceptance.
